NSW: Commuters in Sydney's west get new interchange

New South Wales Premier MORRIS IEMMA says commuters in Sydney's west will find their
daily travel on the city's public transport has improved .. thanks to a new transport
interchange.

The 105 million dollar interchange at Parramatta includes an upgrade of the train station
.. as well as new bus stops and improved security and weather protection.

Mr IEMMA says the project has been completed 10 months ahead of schedule .. and shows
the government's commitment to an improved rail system.

Reserve Bank governor GLENN STEVENS says Australia's economy is benefiting from China's
rapid rise.

Mr STEVENS says China has raised its share of global gross domestic product from less
than four per cent in 1990 to over 13 per cent last year .. while the US share has shrunk
to about 20 per cent from 25 per cent in the same period.

Mr STEVENS made his comment before the American Australian Association in New York
.. in town for the G20 finance ministers' meeting.

He's also warned that concentrating too much on US-China bilateralism is unhelpful
when it comes to solving the world's economic problems .. saying with global economies
changing rapidly .. it's becoming increasingly important to take a multilateral approach
when dealing with the economy.

NSW:Kyogle residents evacuated

SYDNEY, Dec 28 AAP - Residents of Kyogle in far northern NSW have been evacuated by
the State Emergency Service (SES).

The evacuation order was issued for 35 properties at about 6.45pm (AEDT) on Monday.

An SES statement told residents to activate their personal and flood plans and warned
them not to delay their evacuation.

Residents were warned predicted flood levels of 12 metres could rise further and Kyogle
flats was to be evacuated.

Evacuation centres were established at Kyogle's Memorial Hall where temporary accommodation
and other help was available.

ABC Radio said the SES performed four rescues around Kyogle overnight and another rescue
in Queensland.

SYDNEY, Aug 18 AAP - The results are in, and the Labor government led by Prime Minister
Julia Gillard has been returned to power.

Well, not quite.

But that's what would happen if Australian teenagers were to decide the outcome of
the 2010 federal election, according to a mock poll which asked 15-17-year-olds to cast
their ballot.

Five thousand youngsters took part in the `youth election', created by internet giant
Google to determine how the voters of tomorrow regard the major party leaders.

The results show the ALP won a three-seat majority in the House of Representatives,
while the coalition won the popular vote, with the Greens taking the balance of power
in the Senate.

The Google Student Voice 2010 election, conducted between August 9-12, also revealed
that of the 72 electorates where the student vote was captured, Labor won 28 Lower House
seats, the coalition 25 seats, and the Greens 15 seats.

The Christian Democrat Party, Independent, Family First and One Nation won one seat each.

The ALP was strongest in NSW and Victoria, where it won 21 out of 28 seats, while the
coalition took 15 of the 25 seats in the resource-rich states of Queensland and Western
Australia, including the marginal seat of Hasluck, with the Liberal candidate Ken Wyatt
gaining 56 per cent of votes.

The Greens were strongest in Victoria and stormed into retiring Labor MP Lindsay Tanner's
seat of Melbourne - winning more than half the student votes in that electorate.

In the Senate, there was a big swing to the Greens, with Australian students voting
for 16 Green senators, matching the ALP, and only marginally behind that of the coalition.

Google Australia's Director of Engineering Alan Noble says the exercise was one in democracy.

"We hope it inspires students to engage and make their voice heard," he said in a statement.

Mr Noble added that when this generation is old enough to vote, it will be doing so online.

The school students voted for lower and upper house candidates via online ballot papers
in their classes, at lunch, and in the playground between August 9-17.

World Vision Australia chief executive TIM COSTELLO has called on all major chocolate
manufacturers to follow Cadbury's lead and go Fairtrade.

From next year the nation's most popular chocolate bar .. Cadbury Dairy Milk .. will
become Fairtrade certified.

This means a steep increase of the amount of cocoa bought from west Africa under sustainable
farming schemes .. which will also help end child labour and trafficking.

Mr COSTELLO says it's time major chocolate companies go Fairtrade .. and he's called

Refugee advocates say sabotage is unlikely to be the cause of the horrific explosion
on board a boat filled with asylum seekers.

Nearly a dozen asylum seekers are on life support after their boat exploded in Australian
waters off the country's northwestern coast on Thursday.

Three died in the explosion and two remain missing.

LIZ BIOK from the Refugee Council of Australia says it's unlikely they destroyed their
boat to stop being returned to where they came from.

She also says it seems the boat was being refueled at the time of explosion and there
may have been a chemical reaction behind the blast.

BRISBANE, Dec 12 AAP - Mount Isa Mines will be hit with a fifth legal action next week
for allegedly exposing children in the north-west Queensland community to dangerous levels
of lead.

Law firm Slater and Gordon on Thursday served the company, owned by mining giant Xstrata,
with its fourth lawsuit on the issue this week and lawyer Damien Scattini said a fifth
claim would be launched before Christmas.

Mr Scattini said he expected to launch "many more" actions against the company in the new year.

"I don't know how many we'll end up filing but there's more in the pipeline and there's
more contacting us," he said.

The Mount Isa City Council and Queensland government are also named as respondents to the action.

The fourth action was lodged on behalf of 12-year-old Ryan Oliver whose mother Brenda
moved to Mt Isa when she was pregnant in 1995 and remained there until he was 14 months
old.

It is claimed he has suffered learning difficulties, short-term memory loss and attention
deficit hyperactivity disorder as a result of lead poisoning while in his mother's womb.

Mr Scattini said unborn children were the most vulnerable to lead exposure because
the human body could not differentiate between lead and calcium - which is vital for developing
foetuses.

He also criticised the MIM, Mount Isa council and the state government for responding
to the court action by urging members of the community to learn how to live safely with
lead.

"They put the onus onto the mums to clean up their pollution and say if you just don't
allow your child to behave as a child and you use a wet mop everything will be fine -
well that's just not the case," he said.

"If you were to take out the word `lead' and substitute `asbestos' you would see how
ridiculous that is."

A study released in May showed one in 10 children aged under four in the mining town
had elevated lead levels, putting them at risk of behavioural and intellectual problems.

But Queensland government and Xstrata tests have found healthy levels of lead in air and soil.

Comment is being sought from Xstrata.

SYDNEY, Aug 8 AAP - Hordes of couples tied the knot across Australia today, hoping
the eighth day of the eighth month of 2008 would bring them wealth, health and everlasting
love.

In Chinese, the word for eight sounds similar to the word for "prosper" or "wealth".

The 8th day of the 8th month of 2008, chosen for the launch day of the Olympic Games
in Beijing, signifies a particularly lucky day.

The NSW Registry of Births, Deaths and Marriages, which married a record 96 couples
today, extended its opening hours so some couples could marry as early as 8am (AEST) and
as late as 8pm.

Deborah and Marc Johnson from Parramatta in Sydney's western suburbs, who got married
in central Sydney at midday, said they immediately chose August 8 to get married after
they were forced to postpone their previous date.

"I come from a Chinese family and my grandmother told me that eight is supposed to
be a lucky number," Mr Johnson said.

"If you write the number eight it just goes on and on," said Ms Johnson. "There's just
no stop to it. So that would be a symbol for eternity.

"If we get married on this day, that's hoping that we still stay together forever."

Irene and Ferry Lim, who have been together for six years and engaged for just over
a year, said they chose today for their wedding because the numbers were lucky.

"It's also an easy number to remember," said Ms Lim. "We won't forget our anniversary!"

NSW Attorney-General John Hatzistergos told reporters it was "an important occasion
for love and romance".

"I hope the eighth of the eighth is a particularly special day for each of those parties
which are taking place," he said.

Of the 96 couples getting married in NSW today, 41 per cent were Chinese, while another
20 per cent came from other Asian countries, Mr Hatzistergos said.

In Queensland, the Brisbane registry's marriage room on George Street was so busy that
some couples were shuffled across to the Hotel Conrad next door.

Queensland Attorney-General Kerry Shine said 13 celebrants would marry 33 couples,
a record number of weddings for the Brisbane registry.

"It's double the number last year where we had 17 couples marry on 7/07/07," Mr Shrine said.

Two young Brisbane university students from Iran were among the couples to wed.

Alireza and Parisa, both 27, who declined to give their surname, said they originally
wanted to marry at 8am but weren't quick enough to nab that highly coveted time slot.

Instead they made their vows at 8.30am.

"It's special for us ... and we hope it's a lucky day for us," Alireza said.

"We just wanted to marry on the eighth of the eighth month in 2008."

SA's Registrar of Births, Deaths and Marriages, Val Edyvean, counted 10 marriages today
but said the registry had to turn many couples away.

"Certainly there has been much higher demand than usual," he said.

The South Australian parliament's passed the first laws in Australia .. allowing consumers
to make a profit on solar power they generate at home.

Under the new feed-in laws .. consumers using solar power will be paid twice what they're
normally charged .. for any electricity they return to the grid.

Until now .. the returned power's been paid for at the same rate as any power used
.. providing little incentive for consumers to invest in solar conversions.

The state government says its legislation's groundbreaking .. and it expects the federal
government to introduce similar measures on a national basis soon.

MELBOURNE, April 13 AAP - Hazel Hawke's granddaughter says young people can play an
important role in the care and lives of those who develop Alzheimer's disease, and should
not be locked out of the process.

Sophie Pieters-Hawke, 22, was in Melbourne today to launch a kit developed by Alzheimer's
Australia Victoria to help school children understand ageing and dementia.

Hazel Hawke, ex-wife of former prime minister Bob Hawke, revealed in 2003 she had Alzheimer's
disease.

Ms Pieters-Hawke, an honours degree social geography student at Sydney University,
said the impact of dementia and, in particular Alzheimer's, were not limited to those
people who were diagnosed with it.

"It is like a ripple effect that spreads out to family and friends, including children
and young people," Ms Pieters-Hawke said.

"Younger children may not know what is going on, only that mum and dad are upset and
granddad doesn't play with them like he used to.

"There is already enough stigma that surrounds dementia, let us not be ashamed or secretive
about the grief it can cause.

"Young people can play an important role in the care and lives of those who are ageing
and changing.

"Watching a family member or loved one progress through the different stages (of dementia)
can be a trying, upsetting and challenging time, but can also be full of special moments,
laughter and love."

She recalled one of her favourite, and often repetitive, conversations with her grandmother
Hazel.

"One of my personal favourites is when she looks me in the face and says: `Gosh aren't
you a looker'.

"And I say: `Well, I've got good genes', and this ends up with us both giggling and cuddling."

Alzheimer's Australia Victoria executive director Lynette Moore said more than 1,000
new cases of dementia were diagnosed across the country each week.

Ms Moore said 220,000 people in Australia had dementia.

"Young people want to understand what's happening when a member of their family has
dementia," she said.

Ms Moore said there were fact sheets aimed at adults, but virtually no material available
for primary and secondary school children.

The kit, which contained fact and activity sheets, along with story books about dementia,
would fill that gap, she said.

"This kit introduces them to dementia in a sensitive way, helping them with the facts
about ageing and dementia and, most importantly, how they can still relate to and enjoy
the company of a family member or close friend with dementia."

The kit was trialled in three Melbourne schools - Methodist Ladies College, Bentleigh
West primary school and Roberts Mc Cubbin primary school.

Alzheimer's Australia Victoria said it would approach schools from next week about
distributing the kits statewide.

SA: Criminal charges downgraded against McLeod's star

Criminal charges against television star AARON JEFFERY .. for allegedly assaulting
and threatening his wife .. have been downgraded.

JEFFERY .. who plays ALEX RYAN in the Nine Network's McLeod's Daughters .. appeared
in an Adelaide court today .. prosecutors amending a charge of threatening life to the
less serious offence of threatening harm.

He's also charged with one count of common assault against a family member.

The charges relate to an alleged incident last September involving his wife MELINDA
.. at Gawler .. on Adelaide's northern outskirts.

36-year-old JEFFERY has not yet been required to enter a plea to the charges .. if
convicted, he faces up to five years' jail.

SYDNEY, April 28 AAP - The parents of a man killed at work more than 18 years ago have
confronted Employment Minister Kevin Andrews demanding harsher penalties for employers.

As thousands of unionists around the country marked International Workers Memorial
Day today, the issue of tough punishments for industrial manslaughter and improvements
to workplace safety took centre stage.

Mr Andrews, at a breakfast hosted by the National Occupational Health and Safety Council
in Melbourne, announced a new national safety standard for the construction industry.

The minister stood firm on his opposition to industrial manslaughter laws, saying prevention
through cooperation was more effective than legislation.

Deanne May, whose son Gary was one of four workers killed in an explosion fuelled by
unlabelled sodium nitrate at Victoria's Sims Metal, confronted the minister, saying new
safety standards would not go far enough to prevent deaths.

With her husband Jack and members of the Industrial Deaths Support and Advocacy group,
Mrs May told Mr Andrews nothing had changed since her son's death to force employers to
provide safer workplaces.

"We lost our boy 18-and-a-half years ago and we can see all this all happening over
and over again," she said.

"We just want the opportunity to speak with you ... to explain our situation and the
situation we go through as far as the devastation and what our families have to suffer
and go through and it's just, nothing has changed in all this time."

Mr Andrews agreed to meet the family at a later date.

The Australian Chamber of Commerce and Industry also launched its occupational health
and safety reform blueprint, aiming to rein in industrial laws.

The chamber is calling for national standards and says industrial manslaughter, which
exists only in the Australian Capital Territory, should not be pursued.

Mr Andrews said the government opposed industrial manslaughter legislation because
"we shouldn't single out any particular parties".

In Sydney, hundreds of unionists, workers and families gathered in a Sydney park dedicated
to the memory of those who have died on the job.

Andreia Viegas, 27, whose husband Glen was electrocuted last year while demolishing
shop fittings at the Westfield Tuggerah shopping centre on the NSW central coast, called
on all governments to do more to improve workplace safety.

"I don't want Glen to just be a statistic," she said.

"I want his death to be a wake-up call to all employers, employees, governments, and
the whole of Australia.

"Governments must start to spend serious money on implementing tougher laws."

NSW Premier Bob Carr formally unveiled a monument at the park in Darling Harbour, renaming
it Reflection Park as a place of commemoration for workers killed on the job.

About 6,700 Australians die each year in workplace accidents or through work-related
disease, according to the Australian Council of Trade Unions.

Almost 500,000 experience a work-related injury or illness.

It accuses Telstra of a "go-slow" on the introduction of the technology that would open up broadband Internet services to a much wider range of competitors than the present four. KEMPSVILLE - A new communications and arts building planned for Regent University will offer its graduate students everything from writing in an open newsroom to filming on an on-campus back lot.

``It's a building where we want to become first-class journalists, film-makers and first-class thinkers,'' said Michael R. Smith, chair of the school of journalism at the university. ``Even the architecture suggests people who appreciate quality,'' he said.

Last month, the City Council unanimously approved a request to rezone about 9 acres of undeveloped land slated for residential use on the campus to build the Georgian-style, brick building.

The building's project manager, Richard W. Jemiola, said the bid will be opened next month for the facility's general contractors. He said he will not disclose the project's total cost until after a contractor is chosen. University officials plan to finish the building's design by the end of March, start construction sometime after that and complete the project by the fall semester of 2002, Jemiola said.

That would also be the time when university officials plan to launch a graduate program in technical theater, said David V. Jager-Walker, the university's associate professor of theater arts.

He said the building's 750-seat theater and smaller ``experimental'' theater, where students can move audience seats and stage platforms, will allow graduate students to study the technical aspects of the theater, such as stage and sound setting.

Jager-Walker also said the two movie theaters in the complex and a back lot, where facades and street scenes can be filmed, also will help expand the university's theater program. The lot will be fenced in and will be attached to the new building, he said.

Smith said he also expects the new facility to help expand the university's free-lance writing program. Last year, university officials decided not to have a campus paper and instead have their journalism students free-lance with various newspapers and magazines across the nation.

Worst is yet to come, says News of the World head.(News)

REBEKAH BROOKS told News of the World journalists there were worse revelations to come in the hacking scandal during a heated meeting which saw them vent their fury at her 'betrayal'.

The embattled chief executive said that in a year's time staff would all understand why the company had decided to close the newspaper.

They were also told that their London newsroom in Wapping, East London, was effectively being sealed off, with some claiming that they were all being treated like 'potential suspects'.

It came as Andy Coulson, a former editor of the newspaper and British prime minister David Cameron's ex-spin doctor, was arrested yesterday and held for ten hours.

In another move, Mr Coulson's former royal editor Clive Goodman - jailed in January 2007 for intercepting voicemail messages - was re-arrested in connection with alleged bribes to police.

Mr Coulson was held yesterday over allegations of corruption and phone hacking at the News of the World.

He also stands accused of illegally authorising payments to corrupt police officers and of hiring a private investigator who had served seven years in jail.

Last night as he emerged from a police station in Lewisham, South London, he maintained he had attended the station voluntarily, saying: 'There is an awful lot I would like to say, but I can't at this time.' The arrests were made as reporters at the News of the World's London offices challenged Mrs Brooks about her decision to stay on at the helm during the meeting, which was released to Sky News.

In the recording, one member of staff accuses Mrs Brooks of arrogance in believing that they might want to work for her again, followed by a ripple of applause. TV editor Tom Latchem is said to have put Mrs Brooks on the spot, saying that if she had fallen on her sword on Monday, when the Milly Dowler phone hacking scandal broke, it might have saved 200 jobs.

In response, sources at the meeting told how Mrs Brooks provoked derision by claiming she had stayed on to be the 'conductor' for the crisis, and declared she felt 'betrayed' by the allegations of wrongdoing.

She claimed to have 'some visibility' about the revelations to come and that there would have been 'another two years of trouble' if the paper had not been closed. She told reporters she did not expect to be arrested herself.

Her comments came as sensational allegations of a criminal cover-up were made against Rupert Murdoch's faltering media empire last night. Police are investigating claims that News International deleted millions of emails from an internal archive in an apparent attempt to obstruct a police inquiry.

Speculation has been rife about Mrs Brooks's role as the publication's editor at the time that Milly Dowler's phone is said to have been hacked into and her voicemails deleted.

Mrs Brooks admitted she was no longer in charge of the News International investigation into the scandal owing to the potential conflict of interest.

Yesterday journalists told how the News of the World's London and Dublin offices were in 'virtual quarantine' as staff were unable to come and go freely or access the internet or their work emails.

They were also told not to remove any items from the news floor. Staff at the Dublin office said the first that they knew anything was amiss was when an internal email arrived from News Corporation chairman and Rupert Murdoch's son and heir apparent, James, at around 4.30pm on Thursday.

The paper's Irish editor Geoff Frazer then appeared at the door of his office and told staff: 'I only know as much as you know.' Stunned reporters gathered around the newsdesk as journalists from their sister title, the Irish Sun, were assured that they would not be affected.

At around 6pm, many had left News International's city centre offices to go across the road to Ryan's bar on Camden Street where they stayed for a number of hours.

One later told a friend: 'I just cannot believe what has happened. We have been sacrificed for London's sins. It's just obscene. No warning, no consultation - just told that's it. We no longer have a paper to write for.' Another member of staff told her friends yesterday morning that she was crying as she got dressed for one of her last days at the paper.

Nobody has yet been made redundant, but the Irish office's 22 full-time staff have been told they are to be put on 90 days 'gardening leave' - effectively paid holiday for three months.

In London, Mrs Brooks apologised for 'operational issues' relating to the emails, blaming the police investigation, after staff complained that they were being 'treated just like criminals'.

Journalists had glumly returned to work yesterday in the hope of putting out a final edition which would focus on the 168-year-old paper's achievements, although there were fears the email, Twitter and Facebook clampdown would make this difficult.

Staff from its News International stablemate the Sun have been put on standby to help with production if staff do not turn up today.

This was amid growing speculation that the Sun will become a seven-day operation to fill the void left by the News of the World being closed down.

Talking of the closure, Mrs Brooks spoke of her own rise at the Sunday tabloid from secretary to editor at the age of 34, trying to show her loyalty against claims that the paper was sacrificed to protect her. She said the decision to close was 'not taken lightly' but claimed that executives were backed into a corner after advertisers deserted the 'toxic' brand.

She also tried to assure staff that as many as possible would be found jobs elsewhere in the company, paying tribute to the 'talented and untainted' journalists at the paper. Sky sources said Mrs Brooks had told staff a 'quick decision' would be made over whether to publish a Sun on Sunday.

News of the World London staff were yesterday given a letter outlining their redundancy packages. Mrs Brooks wrote to staff: 'While mistakes of the past have led the country's news agenda, News of the World exclusives have set the news agenda around the world. The Company will focus over the coming months on finding as many jobs as possible for the News of the World staff both within News International and the wider company.' When challenged as to why she had not handed in her notice, she told staff she was the 'best person' to lead the company out of its current mess, sources claimed. In the recording, Mrs Brooks told staff: 'This is not exactly the best time of my life'.

She was interrupted by an irate staff member who said: 'By your actions yesterday you are calling our newspaper toxic. We are all contaminated by that toxicity in the way we have been treated.

'Can't you see the bigger picture? You're making the whole of News International toxic, and there's an arrogance there that you think we'd want to work for you again.' Police are examining claims that a News International executive may have expunged millions of emails from an archive believed to date back to 2005.

The Guardian reported that 'massive quantities' of the archive appear to have been deleted on two separate occasions, the most recent in January of this year.

It also claimed the newspaper tried to hide the contents of a senior reporter's desk after he was arrested in April. If proven, the acts would appear directly to contradict claims from News International that it has been co-operating fully with police.

They could also be seized upon by Britain's broadcasting watchdog as it assesses whether the company can pass a 'fit and proper person' test for its proposed purchase of BSkyB.

The same research, commissioned by leading annuity administrators, Xafinity Paymaster, showed that 82% of experts said that providers will quickly adapt to the European Court of Justice ruling on gender equality and greater product innovation would result as providers sought to differentiate.

The results of this survey show that lifetime annuities are still expected to be the most widely selected annuity product over the next five years. In 2011, 95% of respondents supported this stance up from 90% in 2010.

RUSHED HEALTH INSURANCE BILL - BAD DEAL FOR MAINE.

Having served in the Maine Legislature for the last 7 years, I have seen legislation take varied paths to its ultimate fate - whether that is the law books or the recycling bin. The legislative process is designed to be thorough and deliberate.

Last week I witnessed an abuse of the legislative process that I find disturbing. On Thursday, May 5, Republican lawmakers voted along party lines to give initial passage to a complex proposal to axe Maine's health insurance protections without the customary study and public input. You can view my reaction on YouTube.

What's especially concerning is that the bill is about one of the most important issues we work on in Augusta - the cost, quality and access of health care.

Early reviews of the bill suggest it will have damaging impacts on seniors, people living in rural areas and anyone with a pre-existing condition. Unfortunately, the bill was pushed through before the Bureau of Insurance was allowed to study its impact.

The original bill, LD 1333, was sent to the Insurance and Financial Services Committee as a simple four page document. This was the only version that the public had the opportunity to weigh in on at the hearing in late April.

In two day's time, the bill had morphed into a 29 page document. When my Democratic colleagues asked questions about the amended bill there were few answers; and in fact, the state's Bureau of Insurance spokesperson was unable to give feedback to the committee as they usually do, because the document was presented just prior to the work session.

There were multiple attempts to request information and appeals to allow for time to research the most complex parts of the bill - all were denied.

At the final language review the bill was now 45 pages of almost entirely new language that the public never saw and that my colleagues did not have input in. The Republicans of the committee then voted to support the new, longer version.

LD 1333 was then fast-tracked to go before the House in only a few days and literally only hours after the amended bill was available to the public over the internet. Some legislators in the House, from both parties, admitted to not having had time to read and digest the new version they were being called upon to vote for.

During the floor debate in the House many questions went unanswered leaving many to believe that the bill's authors simply did not have them. It was a very strange feeling to hear silence after a question, unlike most cases when the authors proudly explain their viewpoint and want others to understand what they are voting on.

Again, several colleagues asked for time to look at this proposal and again were denied.

There were questions about insurance companies putting Mainers in need of on-going care in a separate insurance pool to fend for themselves, there were questions about repealing the law that keeps insurance companies from sending you to the hospital of their choosing based on price. There were questions about the tax on all insurance premiums.

During the debate I pointed out that we took more time for LD 71, the whoopie pie bill, 52 days from the public hearing to the first House vote. It took eight days for LD 1333 to do the same.

In the end, the House split along party lines to accept the majority's bill 76-72.

I have grave concerns about rushing something as serious as health insurance reform. Any bill that deserves passage should be able to stand up to public scrutiny. I have no problem fighting the good fight and I have no problem losing after healthy debate. What I have a problem with is how this "win" was accomplished.

By the time you read this, the Senate will have worked this bill and hopefully cooler heads will have prevailed to at least let this idea cook a bit longer. But judging from the track this bill is on - I believe it will be fully passed by another partisan vote and headed for the law books and Maine people will be punished for it.

I hope I am wrong.

Gateway Gains Flexibility with Windows; Intel Faces Lawsuit.

DETROIT--May 28--Microsoft Corp., facing government antitrust lawsuits, is allowing computer maker Gateway Inc. to customize the screen that people see when they turn on their computers.

Microsoft agreed to allow Gateway to promote its own Internet-access service on desktop screens and to more easily enable users to choose a non-Microsoft Internet browser.

The Seattle software maker's new flexibility comes just 10 days after it was hit by an antitrust lawsuit. Gateway and Microsoft officials would not say whether the negotiations were spurred by the government's antitrust actions.

Meanwhile, federal regulators soon may file a similar antitrust lawsuit against Microsoft's longtime business partner, Intel Corp., the other half of the so-called Wintel alliance that dominates the PC industry. Government attorneys are preparing charges that Intel illegally abused its power to hurt rivals, Reuters reported.

Wednesday's announcement should boost Netscape Communications Corp., which pioneered the market for Internet browsers. Netscape still dominates the browser market, but has seen its market share drop sharply since Microsoft started giving away its latest version of Internet Explorer last year. The move forced Netscape to do the same with its Navigator product, triggering its first quarterly loss in January and 400 layoffs.

Starting next week, Gateway PC buyers can choose between browsers made by Netscape and Microsoft. Either product can be the default browser, which would automatically run after surfers connect to the Internet.

But to get this choice, consumers must use Gateway's Internet service provider -- Gateway.net -- to connect to the Web, Gateway Chief Executive Ted Waitt said in a telephone news conference.

"We have gained some flexibility in our negotiations with Microsoft," Waitt said. "As far as we know, we are the only PC maker that has made it as easy as possible" to choose the browser.

Previously, people who clicked on the Internet access icon were sent to Microsoft's online service. Microsoft has resisted attempts to allow PC makers to fully customize computer desktops.

This reluctance led to an impasse on May 18 that prompted the federal government and 20 state attorneys general to file antitrust suits against Microsoft. The trial is scheduled to start Sept. 8, far earlier than Microsoft had wanted.

Now Intel could be under government scrutiny. Within the next week, top staff at the Federal Trade Commission will review the proposed charges against Intel. The FTC may vote to approve narrow charges against Intel, according to Reuters. Those charges are likely to be broadened later.

"I can neither confirm nor deny that," said an FTC spokeswoman, adding that the agency never comments on pending decisions.

The FTC has studied other cases involving Intel, which have taken place outside of Washington, but which establish some of the broad outlines of the case.

Last month, a federal judge in Alabama ruled that Intel abused its market dominance by cutting off information and enabling technology that Huntsville, Ala., computer maker Intergraph Corp. needed to stay in business.

The judge issued a preliminary injunction ordering Intel to provide the same kind of service to Intergraph it provided to other customers. Intel followed the order but appealed.

The cases provide the factual basis for the FTC to make assertions similar to those Intergraph made in its private antitrust lawsuit: that Intel is violating the law by using its power to force others to give up their trade secrets or cooperate with Intel.

The FTC has studied that decision and Intel's actions since it brought charges against Intel in April for its actions against computer equipment maker Digital Equipment Corp.

American Phoenix Group Inc. Signs Letter of Intent With Tetherless Access Asia Ltd.

Faster release of hydrogen.(MATERIALS)

Researchers at the Pacific Northwest National Laboratory (PNNL), USA, have used silicon oxide (silica) and nanotechnology in a novel system that releases hydrogen from a solid compound at much faster rates than was previously possible.

Normally, the solid compound--ammonia borane--discharges hydrogen at a slow rate of release (which is carried out at temperatures below 80[degrees]C).

However, by making the ammonia borane as a nano-sized particle, a system was devised in which the hydrogen was released approximately 100 times faster compared with conventional bulk material, the researchers say.

In the system, the scientists first dissolve the solid compound in a solvent and then add the solution to nanoscale mesoporous silica, which acts as a scaffolding material.

The capillary action of the porous material pulls the ammonia borane into the pores of the support. When the solvent is removed, nanosized pores--about 6.5 nm in diameter--filled with ammonia borane are left.

Based on computational thermodynamic analysis, the researchers believe the process may eventually be designed to be reversible, which would allow the storage material to be regenerated and provide a sustainable hydrogen storage compound with a longer lifetime.

A patent is pending on the process.

Brussels --The European Commission has opened an in-depth investigation under EU state aid rules into an Estonian project to grant state support of up to EUR1.5 billion spread over 20 years to the operators of two newly-constructed 300 MW power plants. The aid would be paid for the mere availability of the plants, provided that they are mainly fuelled with oil-shale, a hydrocarbon widely available in Estonia. Estonia claims that the aid is necessary to increase the security of energy supply. While the Commission acknowledges the importance of securing energy supplies, it has, at this stage, doubts that the proposed Estonian measure would be the least distortive means to achieve this objective. In particular, large-scale subsidies would be allocated over a long period without a tender procedure. This could result in discouraging investment into alternative technologies in Estonia and in neighbouring Member States and in crowding out competitors, who would have to operate without such aid. The opening of an in-depth investigation allows interested third parties to comment on the measure under scrutiny. It does not prejudge the outcome of the procedure.

Commission Vice-President in charge of competition policy Joaquin Almunia said: "While the Commission recognises the special circumstances of the electricity market in Estonia, the specific design of this measure has the potential to seriously disturb competition and could discourage investment in other technologies in Estonia and neighbouring Member States."

Estonia plans to grant state aid of up to EUR75 million annually over 20 years (i.e. a maximum of EUR1.5 billion) for the operation of two oil-shale power plants in order to increase its locally-installed electricity generation capacity between 2013 and 2016. Estonia contends that planned domestic generation capacity and electricity interconnections with other Member States in the Baltic region are insufficient to address future risks to its security of supply.

The proposed scheme would require that the plants be operated with oil-shale as their main fuel. The duration of the scheme would be from 2013 at the earliest until 2032 at the latest. The aid would be in the form of a direct grant remunerating the mere availability of the plants. The amount would be calculated on the basis of the hours of availability of the plants multiplied by an amount fixed in accordance with average CO2 prices on international markets. Oil-shale is one of the most CO2-intensive fuels and virtually no electricity generator in the world other than the publicly owned incumbent Eesti Energia uses it for wide-scale electricity generation.

The Commission acknowledges the necessity to secure the supply of electricity. However, at this stage, the Commission has doubts whether the proposed measure, in its current form, is in line with EU state aid rules.

In particular, no competitive tender is foreseen and, therefore, the most likely beneficiary of the measure would be the fully vertically integrated incumbent energy company Eesti Energia that has significant activity along the whole value chain from mining to electricity distribution, with shares of more than 75% in all these activities in Estonia. Moreover, the aid would be granted irrespective of future sales revenues from electricity generation and there would be insufficient mechanisms to avoid possible windfall profits from such generation. Finally, in view of the substantial amount of aid and the long duration of the scheme, third parties have already raised concerns that the aid might crowd out existing plants and discourage investments in new plants both in Estonia and in neighbouring markets, since competing plants -- contrary to the subsidised new plants -- would be obliged to bear their full investment costs.
